Personal Injury Lawyer in Rochester
What is a personal injury?
Personal injury is a legal term used to define harm to a person’s body, mind, or emotions. In the United States, this term is most commonly used in reference to the tort lawsuit that claims the plaintiff’s injury to mind, body, or emotions has been caused by the negligence of another. If you believe you may have grounds to pursue a personal injury case, allow Sciarrino & Sciarrino to assist you.
If you take my case, what will be the fee charged?
We typically handle personal injury matters and charge clients what is called a contingency fee. This means that our fee for the legal services we provide will be based on a percentage of what we recover for you. In most cases the percentage is a third of the net recovery. The net recovery refers to the amount recovered less the expenses incurred to obtain the recovery. For example, if the recovery is $104,000 and the case expenses were $5,000, the net recovery would be $99,000 and the fee would be a third of that, or $33,000. If you do not recover, there is no fee charged. Medical malpractice cases have a special sliding fee scale that depends on the amount recovered. The scale starts at 30% and drops to 10% once the recovery exceeds $1,250,000. If we accept your case we will enter into a written contingency fee retainer agreement that will clearly explain all of these details.
Generally, the most common types of personal injury claims arise from:
- Motor Vehicle Accidents
- Premise Liability
- Wrongful Death
- Product Liability
- Animal & Dog Bites
- Medical Malpractice
- Construction Accidents
